Litigation can be a blunt instrument for resolving disputes. After a judgment has been rendered, there is usually a clear winner and loser. Both parties likely have incurred substantial legal fees and the unsuccessful party must often pay a portion of the successful party’s legal costs.

Sometimes even more importantly, litigation can be fatal to relationships. Too often neither side is interested in working with the other after the ordeal of a trial and winning or losing.

Mediation is one form of alternative dispute resolution (ADR). A third party, the mediator, assists the parties to negotiate an acceptable solution to the disagreement. This solution is a settlement. The third party mediator is generally selected by the parties with the assistance of their legal advisors. The skilled mediator will help both sides discover their underlying interests in the dispute and facilitate a solution that serves the interests of all. Resolution of disputes by mediation - an agreed settlement - is often quicker, less expensive and is always much less risky that going 'all the way.' In addition, mediation can have the added benefit of preserving a positive working relationship for the two parties where both sides want the employment relationship to succeed.
